1. About these terms
These Terms and Conditions apply to the Lamassu Care mobile app, the web platform at app.lamassucare.com.au, this website, and related account, attendance, timesheet, activity log, document, and organisation features.
Lamassu Care is operated by Pegasus Solutions Pty Ltd (ABN 79 665 783 773).
By accessing or using Lamassu Care, you agree to these terms. If you use Lamassu Care on behalf of an organisation, you confirm that you are authorised to bind that organisation to these terms.
For questions about these terms, please use the contact form on the Contact page.
2. Users and account types
Lamassu Care is intended for Australian users and organisations, including authorised individuals, workers, subcontractors, office staff, and organisation representatives using the service in connection with NDIS and Aged Care provider operations.
Access is role-based. Features and permissions may differ depending on your role, organisation settings, subscription, account type, and whether the relevant workflow is configured for participant or client records.
Individual self-signup accounts require explicit acceptance of the terms applicable to individual accounts at sign-up or first use.
3. Service scope and changes
Lamassu Care provides software tools for account management, attendance, timesheets, activity logs, documents, and related operational workflows. Features may change, be added, withdrawn, restricted, or made available only to certain users, roles, organisations, subscriptions, or account types over time.
4. Authentication and account access
Users may sign in with passwords and, where available, passkeys. Passkeys may rely on device-level authentication such as Face ID, Touch ID, fingerprint, device PIN, or equivalent platform authentication. Remembered logins, session persistence, first-time login flows, password recovery flows, and temporary credential delivery workflows may be used where applicable.
You are responsible for maintaining the confidentiality of your account credentials, controlling access to your devices, and ensuring that your use of the service is authorised.
5. Organisation account visibility and control
For organisation and business accounts, records created or stored in Lamassu Care may be reviewed, managed, exported, or acted on by authorised personnel of that organisation. This can include employers, admins, directors, HR managers, coordinators, office staff, or other authorised representatives of that same organisation.
This organisation-level access does not mean Lamassu Care is supervising or directing the underlying service delivery. It means the platform allows the organisation to access and manage its own operational records subject to role-based permissions.
6. Individual account responsibilities
If you use an individual account, you are responsible for the client, participant, service, attendance, timesheet, activity log, and document information that you manually enter or upload. You warrant that information you submit is accurate, current, and authorised for entry into the platform.
If your organisation does not use the Support Worker Timesheet Creation Premium Add On, your organisation is responsible for obtaining and retaining the signed support worker timesheet records it requires for its own operations, record keeping, and claim-support purposes. Those records may include the participant and any other required authorised signatory, including the support worker where required by your organisation's process. Lamassu Care does not replace your organisation's manual signed timesheet process where that add on is not in use.
When the Support Worker Timesheet Creation Premium Add On is enabled, authorised users may send secure participant or client signature links by email for review and signing. Organisations remain responsible for ensuring recipients, contact details, and records are accurate and authorised.
If your organisation submits claims or related records to the NDIA or a plan-managed agency, your organisation remains responsible for ensuring it holds the supporting signed timesheet records it requires.
7. Acceptable use
You must not misuse Lamassu Care, attempt unauthorised access, interfere with service security, reverse engineer protected parts of the platform except where the law cannot exclude that right, or use the service in a way that harms Lamassu Care, users, clients, participants, or organisations.
- You must not create fake attendance or fake clock-ins.
- You must not spoof, falsify, or manipulate location data.
- You must not enter false or misleading timesheets.
- You must not enter false or misleading activity logs.
- You must not impersonate another user or share accounts improperly.
- You must not submit false, misleading, or unauthorised participant or client information.
8. Suspension and termination
We may suspend, restrict, or terminate access to Lamassu Care if we reasonably suspect repeated misuse, suspected fraud, a breach of these terms, security risk, payment failure, or other conduct that threatens the platform or its users.
9. Orders, payments, billing, and refunds
Subscription checkout is processed through Stripe. You are responsible for providing accurate billing details and keeping your payment method valid.
Refunds are available within 14 days of the start of a monthly billing period. After 14 days in that billing period, no refund is available for that period unless required by law.
10. Data handling and deletion
Data handling, storage, deletion, and retention are described in the Privacy Policy. For business and organisation accounts, deletion timing may depend on organisation status, subscription status, authority over the account, operational wind-down, and any more specific retention setting or notice presented for the relevant account type or workflow.
11. Backups, crashes, and support response
You are responsible for maintaining any backups you require. Lamassu Care does not guarantee uninterrupted availability, error-free operation, or restoration of locally stored drafts or unsynced device data in every circumstance. We generally aim to respond to reported issues promptly, but response and fix times are not guaranteed.
12. Liability
To the maximum extent permitted by law, Lamassu Care is not liable for indirect, incidental, special, or consequential loss, or for loss of profits, revenue, goodwill, data, or business opportunity arising from use of the service. Nothing in these terms excludes rights or guarantees that cannot be excluded under Australian law.
13. Governing law
These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes are subject to the courts of Victoria, Australia.
14. Changes to these terms
We may update these terms from time to time. Changes are effective when published on this page with a revised effective date.
